Terms of service

Terms and Conditions
Last updated: 29 September 2026

1. Scope
1.1 These terms apply to all orders placed by consumers in the online shop at lucastiefenthaler.com (the "shop"). The seller is Lucas Tiefenthaler, Schlößlestraße 56a, 6832 Röthis, Austria, VAT number ATU73399119, email office@lucastiefenthaler.com, phone +43 650 6936659 ("I", "me").
1.2 The contract language is English. On request I am happy to communicate in German.

2. Products
2.1 Fine art prints are produced to order by my print partner WhiteWall Media GmbH, Frechen, Germany, and shipped directly from there. The Arlberg calendar is shipped by me from Austria.
2.2 Product images show the motif and material as accurately as possible. Colours on screen can differ slightly from the print because of monitor settings.

3. Conclusion of contract
3.1 The products shown in the shop are not a binding offer but an invitation to place an order.
3.2 The ordering process: choose the product and options, add them to the cart, enter your details, choose the shipping and payment method, review your order and correct it if needed, then send your binding order by clicking the button "Pay now".
3.3 After your order you receive an email confirming receipt of the order. The contract is concluded when I accept your order by sending an order confirmation or shipping confirmation by email, or at the latest when the goods are dispatched.
3.4 I store the contract text. You receive your order details and these terms by email and can view past orders in your customer account.

4. Prices and payment
4.1 All prices are in euro. For deliveries within the EU they include the statutory VAT. For deliveries to Switzerland no EU VAT is charged; import VAT, customs duties and carrier fees may apply on delivery and are paid by the recipient.
4.2 Shipping costs are shown on the shipping policy page and in the cart and checkout before you place your order.
4.3 The available payment methods are shown at the beginning of the checkout, for example credit and debit cards, PayPal and Klarna. Payment is due when you place the order.
4.4 You receive an electronic invoice by email.

5. Delivery
5.1 Fine art prints are delivered to the EU and Switzerland. The Arlberg calendar is currently delivered within Austria only. Delivery areas and times are shown on the product pages and the shipping policy page.
5.2 Unless stated otherwise, delivery takes place within 30 days of conclusion of the contract.

6. Right of withdrawal
As a consumer you have a 14-day right of withdrawal. The details, the model withdrawal form and the online withdrawal function ("Withdraw from contract here", linked at the bottom of every page) are described in the right of withdrawal.

7. Legal guarantee
7.1 The statutory legal guarantee applies (in Austria the Consumer Warranty Act, VGG). The guarantee period is two years from delivery. If a defect appears within the first year after delivery, it is presumed to have existed at the time of delivery.
7.2 If goods are defective, you are first entitled to repair or replacement free of charge. If this is not possible or fails, you can ask for a price reduction or, if the defect is not minor, cancel the contract.
7.3 Please report defects to office@lucastiefenthaler.com, ideally with your order number and a photo. If you notice transport damage, please also report it to the carrier if possible. Not doing so has no effect on your legal guarantee rights.
7.4 More information on the legal guarantee, including the EU legal guarantee notice, is available on the page "Legal Guarantee".

8. Liability
I am liable without limitation for intent and gross negligence and for personal injury. For slight negligence I am only liable for the breach of essential contractual obligations. Liability under the Austrian Product Liability Act remains unaffected.

9. Retention of title
The goods remain my property until full payment.

10. Copyright
All photographs remain protected by copyright. Buying a print gives you ownership of the physical print for private display. It does not grant the right to reproduce, publish or use the image commercially.

11. Applicable law and disputes
11.1 Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer with habitual residence in another country, this choice of law does not deprive you of the protection of the mandatory consumer protection provisions of your country of residence.
11.2 If a problem comes up, please contact me first at office@lucastiefenthaler.com. I am not obliged and not willing to take part in dispute resolution proceedings before a consumer arbitration board.
